Service Availability and Changes

- Update, change, or replace any AI models or providers used in our Services

We will endeavor to maintain high availability, but we do not guarantee uninterrupted access to our Services.
Included Previews and Monthly Plans
The Fresh Sky AI main website is informational and does not require payment to browse. Guests share three lightweight previews across the portfolio. Continued use requires the clearly displayed Focus ($9.99), Civic ($14.99), Plus ($19.99), or Advanced ($29.99) monthly plan. Provider safety controls, security protections, outages, budget safeguards, and infrastructure safeguards may still temporarily affect availability.
Fresh Sky AI offers monthly Focus ($9.99), Civic ($14.99), Plus ($19.99), and Advanced ($29.99) plans. Focus selects one non-civic workspace with 100 usage units per month and 20 per day. Civic covers CivicOps with 200 units per month and 40 per day. Plus covers EduSafe Studio, Action Packs, and Private Utility Lab with 300 units per month and 60 per day. Advanced covers all five workspaces with 600 units per month and 120 per day. Usage is shared across participating modules by the verified checkout email. Every agentic workflow declares its unit cost before starting. There are no annual plans or automatic overage charges. A plan begins only after successful checkout and renews each month until canceled.
You may cancel through the Stripe-hosted billing portal. Unless otherwise required by law, cancellation takes effect at the end of the current paid billing period and access continues through that date. To request review of a duplicate, unauthorized, unavailable-service, or other subscription charge, contact Fresh Sky LLC within seven days of the charge. Refund decisions account for tool usage, service availability, and applicable law; this policy does not limit non-waivable consumer rights.
The Agent Opportunity Audit is a separate $249 one-time, fixed-scope organization funding and readiness service. After Stripe verifies payment, Fresh Sky creates one report from the de-identified organization, program, funding-goal, and readiness brief submitted before checkout and displays it in the browser. It identifies preparation lanes and evidence gaps; it does not promise an award, establish eligibility, identify a specific opportunity as currently open, include a meeting or implementation, or create a subscription. A recent report can be recovered for 30 days using the original success link or the same browser session. Contact Fresh Sky promptly if verified payment succeeds but the report remains unavailable.
Separate fixed-scope consulting work may be offered under a written agreement. Those arrangements do not change access, ranking, AI outputs, or priority in monthly-access tools.
App Studio Beta
Fresh Sky App Studio creates temporary, text-only AI tool configurations. It does not create or execute software code, deploy applications, provide a permanent public URL, connect third-party accounts, or take autonomous action. Blueprints expire, features may change, and generated tools remain subject to the same acceptable-use, privacy, accuracy, and professional-review requirements as the rest of the Services.
Fixed-Scope Commercial Services
The fixed-scope Agent Opportunity Audit and separately scoped consulting are not tool subscriptions and never influence tool answers, ranking, privacy, or access. A written scope controls any custom implementation work.
The Agent Opportunity Audit is a fixed-scope, self-serve digital funding-readiness service. After verified payment, the written report is generated from the de-identified organization brief and displayed in the browser. It does not include a meeting, filing, certification, signature, submission, implementation, software deployment, monitoring, or owner follow-up. Previously purchased AI Workflow Starter reports remain recoverable through their original links but are not offered for new purchase. If you are not satisfied, contact Fresh Sky LLC within seven days after delivery to request a refund. Fresh Sky LLC may also cancel and refund an order it cannot safely or lawfully fulfill.
Commercial customers do not receive influence over answers, rankings, eligibility results, sensitive-tool placement, or other users' access. Fresh Sky LLC does not guarantee revenue, savings, traffic, regulatory approval, or other business outcomes.
Approval-Gated Automation
Fresh Sky LLC may use internal automation to classify business inquiries and prepare drafts. Automated drafts are not sent, published, deployed, charged, refunded, or treated as binding commitments without human approval.
Data Collection and Storage
Some products may store limited data needed for their stated functionality. Public education AI tools are intended only for de-identified scenarios and must not be used to submit education records or student PII.
Use of a Fresh Sky AI product does not by itself establish FERPA or COPPA compliance. Schools and districts are responsible for authorization, direct control, contracts, consent where required, retention rules, and their own legal and security review.
Third-Party Services
Our applications integrate with third-party AI providers. Your use of these Services may also be subject to those providers' terms of service. Fresh Sky LLC is not responsible for the actions or policies of third-party providers.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of New Jersey.
